Yesterday Scott Lemieux did a great job of enumerating the shortcomings of the Kagan pick, as well as knocking down the silly notion that any new liberal justice is going to rise to the court and magically change how Anthony Kennedy feels about things. I'm not sure I've heard an administration talking point repeated as breathlessly since Obama announced he wanted a "Team of Rivals" in his Cabinet.
For what it's worth, though, conservative legal expert Eugene Volokh looked at Kagan's scholarship and came away with a pretty positive impression.
